Combine your communication and critical thinking skills in this challenging role
The Residential Tenancy Branch is part of the Office of Housing and Construction Standards in the Ministry of Housing. The Branch promotes successful tenancies by providing high-quality, plain language information to landlords and tenants about their rights and responsibilities and by delivering timely, neutral dispute resolution services to landlords and tenants
Reporting to the Manager, Dispute Resolution, the arbitrator works in a dynamic and often highly volatile environment and must use a high level of discretion and judgment. In all cases, the arbitrator must remain neutral throughout the adjudication process.
The Arbitrator is responsible for providing landlords and tenants with an orderly, timely, and effective dispute resolution. The arbitrator conducts hearings in a respectful and effective manner and provides clear, concise and well-reasoned written decisions within established time limits. The arbitrator may also encourage settlements between landlords and tenants.
The work requires independent decision-making combined with the ability to diffuse volatile situations and deal effectively with emotionally charged individuals while focusing on fair outcomes. The arbitrator works in a high volume, demanding and fast-paced environment and must be able to respond promptly to changing priorities and deadlines.
Arbitrators are recognized subject matter experts in the interpretation and application of the Residential Tenancy Act, the Manufactured Home Park Tenancy Act and associated Regulations, Rules of Procedure, and Policy Guidelines. They also apply the common law that relates to landlords and tenants which is not codified in the legislation.
Arbitrators make decisions having considerable long-term impact on the citizens of British Columbia and deliver significant services with ministry-wide implications: deciding whether tenancies must end; ordering landlords or tenants to comply with legislation; and making monetary awards up to $35,000 (a limit statutorily aligned with the Provincial Court, Small Claims Act limit). Orders of possession are enforceable in the BC Supreme court. Monetary orders are enforceable in the BC Provincial Court. An arbitrator is responsible for delivering clear and well-reasoned decisions for each dispute or review consideration within the 30 days prescribed by statute. Often an arbitrator must make and deliver their written decision within hours of the hearing, in order to end or maintain a tenancy relationship.
Our Dispute Resolution Team is an engaged team of highly efficient, knowledgeable, supportive and positive professionals who provide timely, consistent, effective dispute resolution services. We embody best practices, continuous learning, and a culture of continuous and measurable improvement.
As an Arbitrator, you focus on high quality service delivery providing landlords and tenants with an orderly, timely, and effective dispute resolution process. You conduct a high volume of teleconference hearings and occasional face-to-face hearings in a respectful and effective manner and provide clear, concise, and well-reasoned written decisions within established time limits.
